End User License Agreement (EULA)

1. Agreement to Terms

This End User License Agreement ("Agreement") is a legal agreement between you and Letspeedtest ("Company", "we", "us", or "our") for the use of the Letspeedtest application ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.

2. Grant of License

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the Software on devices you own or control
• Use the Software for personal or commercial purposes
• Make backup copies of the Software for archival purposes

3. Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the Software
• Modify, adapt, or create derivative works based on the Software
• Remove, alter, or obscure any proprietary notices on the Software
• Use the Software for any illegal or unauthorized purpose
• Distribute, sublicense, rent, lease, or lend the Software to third parties
• Use the Software in a way that could damage, disable, or impair our servers or networks

4. Intellectual Property

The Software and all rights, including intellectual property rights, are and shall remain the property of the Company. This Agreement does not grant you any rights to trademarks, service marks, or trade names of the Company.

5. Updates and Modifications

We may provide updates, patches, or modifications to the Software. Such updates may be automatically installed without providing additional notice or receiving additional consent. You consent to such automatic updates.

6. Data Collection

The Software may collect certain data as described in our Privacy Policy. By using the Software, you consent to such data collection and processing in accordance with our Privacy Policy.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE.

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.

11. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding the Software and supersedes all prior agreements and understandings, whether written or oral.
